Division 13. ROR Residential/Office/Retail District.

Section 13.1. Purpose and intent.

The ROR Residential/Office/Retail District is intended for mixed use areas designated within the ROR Residential/Office/Retail land use category on the Future Land Use Maps. Certain other structures and uses required to serve governmental, religious and non-commercial recreational needs of such areas may be permitted, subject to restrictions and requirements intended to preserve the character of such district.

Section 13.2. Permitted principal uses and structures.

Subject to the provisions or restrictions contained in this section and elsewhere in this code, permitted uses and structures in the ROR Residential/Office/Retail District are as follows.

(a) Clubs, community service.

(b) Eating and drinking establishments – Sit-down restaurant only.

(c) Financial institutions without drive-through service.

(d) Laundries, self-service.

(e) Offices.

(f) Printing and copying services.

(g) Residential dwellings – Attached single-family, detached single-family, multifamily and two-family.

(h) Retail sales.

(i) Social service agencies.

Section 13.3. Permitted accessory uses and structures.

(a) Uses and structures, as regulated in Sections 6.12 and 6.13, which are customarily accessory and clearly incidental and subordinate to permitted or permissible uses and structures and are not of a nature prohibited under Section 13.5.

(b) Home occupations, subject to the conditions set forth in Section 6.5 of this code.

(c) Residential docks, including tie poles, in conformance with the provisions of Section 6.23 and other applicable codes and ordinances of the city, county or state.

(d) Temporary structures under the provisions of Section 6.11.

Section 13.4. Allowable conditional uses.

Subject to the provisions or restrictions contained in this section and elsewhere in this code, allowable conditional uses in the ROR Residential/Office/Retail District are as follows.

(a) Assisted living facilities.

(b) Places of worship.

(c) Communications facilities.

(d) Daycare centers/kindergartens.

(e) Docks, commercial – Class C only.

(f) Eating and drinking establishment – Bar cocktail lounge, saloon); restaurant, outdoor

(g) Laundries, dry cleaning.

(h) Parking lots, off-premise.

(i) Recreational – Public parks and/or recreational facilities.

(k) Schools, public or private.

(l) Schools, commercial.

(m) Services, personal/business.

(n) Transient accommodations – Bed and breakfast inns and motels.

(o) Utility substations and/or rights-of-way.

(p) Veterinarians.

Section 13.5. Prohibited uses and structures.

All uses and structures not of a nature specifically or provisionally permitted herein are hereby prohibited in the ROR Residential/Office/Retail District.

Any use which has been determined under the provisions of Chapter 46 of the Code of Ordinances to be potentially noxious, dangerous or offensive to residents of the district or to those who pass by on public roadways or likely for other reasons to be incompatible with the character of the district, is hereby prohibited in the ROR Residential/Office/Retail District.

Section 13.6. Minimum zoning lot requirements.

The maximum residential or transient accommodation densities permitted in the ROR Residential/Office/Retail District shall not exceed 15 units per acre. The minimum lot area and width requirements in the ROR Residential/Office/Retail District are as follows:

(a) Detached single-family dwellings.

(1) Lot area: 5,000 square feet.

(2) Lot width: 50 feet.

(b) Attached single-family, multifamily and two-family dwellings and transient accommodation facilities.

(1) Lot area: 2,904 square feet for each dwelling unit or transient accommodation unit.

(2) Lot width: 50 feet.

(c) All other uses. The lot area and width requirements stated below shall be considered the minimum standards; however, the requirements may be modified by the city under the site plan review process to fit the specific use.

(1) Lot area: 5,000 square feet.

(2) Lot width: 50 feet.

Section 13.7. Minimum yard requirements.

The minimum yard requirements for principal structures in the ROR Residential/Office/ Retail District are as required in this section. No structures shall be permitted seaward of the city’s Coastal Construction Setback Line.

(a) Residential dwellings and transient accommodation uses.

(1) Front yard: 20 feet.

(2) Secondary front yard: 10 feet.

(3) Side yard: 10 percent of the lot width.

(4) Rear yard: 20 feet.

(5) A minimum of 30 percent of the total required yard areas shall be maintained as green space.

(b) All other uses. The yard requirements stated below shall be considered the minimum standards; however, the requirements may be modified by the city under the site plan review process to fit the specific use.

(1) Front yard: 20 feet.

(2) Secondary front yard: 10 feet.

(3) Side yard: 10 percent of the lot width.

(4) Rear yard: 20 feet.

Section 13.8. Maximum height of structures.

The maximum height for all structures shall be 30 feet.

Section 13.9. Minimum off-street parking requirements.

Section 13.10. Landscaping required.

All uses shall be landscaped in accordance with the provisions of Division 22 of this code.

Section 13.11. Maximum floor area ratio.

Maximum floor area ratio (FAR) for non-residential uses: 0.40

Section 13.12. Maximum impervious surface ratio.

The lot area used in the calculation of the maximum impervious surface ratio shall exclude any portion of the property lying Gulfward of the City’s Coastal Construction and Excavation Setback Line.

Maximum impervious surface ratio (ISR) for residential and transient accommodation uses: 0.70

Maximum impervious surface ratio (ISR) for non-residential uses: 0.85
