Future Land Use Policies - Nonconformities and grandfathering

Objective 1.5

Existing land uses or structures which are either incompatible or inconsistent with the adopted Future Land Use Element shall be deemed non-conforming as of the effective date of this comprehensive plan and be encouraged to be eliminated through redevelopment of such uses or structures; however, existing residential densities shall be grand-fathered except when excess residential units have been abandoned voluntarily.

Policy 1.5.1

Those residential uses and structures existing as of the effective date of this comprehensive plan, as amended, which were built and were conforming prior to such adoption, and which are hereby rendered non-conforming, shall be considered to be grand-fathered, as defined in the land development regulations.
